ALSO: Be sure to find out -- before the trial -- what the witnesses remember your client saying during the incident. If he or she cursed or made a threat then it will look as though it was intentional. Similarly, if he or she did not say anything like that (or if they said something like "excuse me" ) then it indicates that it was NOT intentional.

Cross-examination is your chance to ask questions about what the witness has already testified to but chances are your teacher will allow you to ask about anything that is pertinent to the case.

Generally the rule is DO NOT ASK A QUESTION THAT YOU DO NOT ALREADY KNOW THE ANSWER TO so try to interview the witnesses before the trial. Just be careful not to come across like you are trying to influence them since opposing counsel can ask them what you told them (Just as you can ask the witness about anything the prosecutor said to them)

Look for opportunities to show that a) the hostile witness was not in a position to see what happened b) that the hostile witness has some kind of bias against you Client.

If you get to the library look for Mauet "Fundamentals of Trial Techniques"

And, believe it or not a movie called "My Cousin Vinnie" although a comedy actually shows an look at some pretty effective defense counsel cross-examinations. Rent it watch it. Have a laugh and think about what he focuses on in cross examination

Any one who wants to can hire a lawyer. Anything you say in front of witnesses can be used as evidence against YOU. If you are asking if getting a rude text is grounds for a lawsuit, the answer is no.

You cannot enter into a contract with an attorney, since you are a minor. When you are 18 or emancipated, you can get your own lawyer.

Your parent or guardian can get an attorney for you.

''I'm a defense lawyer '' but according to your profile you say - ''I'm a sophomore in college''

Which is it ? - I suspect neither.

Besides , defence lawyers don't come to Yahoo Answers and ask for opinions.....

You are just another little kiddie playing games.

Mmmmm, waitaminute. You are -defending- Jesus from the charge that he -exists-? You've got me over an epistemological barrel. What kind of argument is that? Simply existing is not a criminal matter. If he doesn't exist, how can he be accused of a crime. . . the crime of existing? Ow! My head hurts.

Yes, Josephus is manufactured evidence. There is no real evidence that Jesus existed. But then there isn't any evidence for ANYONE in that time except Roman emperors and a few other high level VIPs. That there are no contemporary records of Jesus' existence is completely consistent with who he was. If there -were- records, they would be highly suspicious.

Josephus' writing (on Jesus) could not be true because while Origen was vigorously defending Christianity against Celsus sometime in the early 3rd century, Origen could have used Josephus' brief mention of Jesus (as the Christo). But Origen's 1 million words in his defense seemed to leave out an important reference to a well-known 1st century historian, Josephus. *Many other writers of the 2nd and 3rd century did not reference to Josephus' mention of Jesus, and these provide a key as to why the forgery was confirmed to be a redaction.
It was widely considered that the brief mention of Jesus by Josephus was a pious fraud (forgery) committed by Eusebius in the 4th century.
If Christianity and Christians had existed in the aftermath of the "crucifixion", then such terms would have been prevalent in the latter part of 1st century. However, from such prolific writings of so many writers, no one mentioned such terms. The first to use "Christians" was by Suetonius, sometime in the early 2nd century.
Paul (3 - 67 AD) should be a contemporary of Jesus (if he existed). For such a person with so much vigor to write 13 books on Christianity, doesn't anyone find it odd that Paul did not write anything about Jesus' life? Won't it be surprising that Paul did not physically witness anything about Jesus (his miracles, his resurrection) except that he got "visions" of the resurrection after the crucifixion?
Since Paul wrote most of his books before the 4 canonized gospels (these gospels were written some time between 70 to 90 AD), would it be odd that the gospels did not mention any reference to Paul's writings? Would it not be odd that Paul did not make any effort to meet with the disciples or Jesus' mother? As Matthias was chosen to be the 12th disciple to replace Judas, then why did Paul made himself the self-proclaimed apostle? The only conclusion is that the 12 disciples were as mythical as the master himself, and hence during the heydays of self-claimed messiahs, apostles and fakirs, the period was ripe for breeding some sort of religion for the uneducated masses. Along some simple basic hearsay or rumors, people were writing their own gospels in abundance to preach their brand of religions, along a common line. There was urgency and desperation among the Jews as there were many insurrectors fighting guerilla wars culminating in the destruction of the temple in 70 AD. The Jews were oppressed and any self-claimed messiah to bring hope to their salvation (albeit a spiritual one) would not be ludicrous when the majority of the Jews were concerned with survival and destruction. Therefore, some cults set themselves apart, to be away from the Jewish effort in the insurrection against the Romans.
For the Jewish diaspora, during times of great stress and dangers, there were prolific introduction of great figures like Moses and David. Yet, these characters are as fictitious as they were a great hope to the oppressed people. It would not be absurd if someone wrote about a great hope, though it could start as an idealised notion and an appeal, of a salvation figure, without the actual flesh-and-blood person existing. It could be a slant on the ideal Jesuses (Jesus ben Sirach, Jesus ben Ananias, Jesus ben Damneus, Jesus ben Pandira) for there was no lack of Jesuses during that time to fall back on.

Not all of Josephus's writings about Jesus are thought to be forgery(Something about a "wise king"--excuse my memory) But my question is, how did christianity come to be at all if Jesus didn't exist? Would people have gone to their deaths to defend a myth? Wouldn't the early enemies of christianity simply said Jesus was a fake?
