If there is an open apply to for a associate as well as which associate is already married. How does a INS (immigration) check it out? Are there checks which they go by to find out if they have been already married?

I’m not sure, but I hope they step it up. To the answerer below, if you don’t like the fact that this person is helping to enforce our laws, and will not turn a blind eye to this atrocity, perhaps the USA isn’t the place for you. I’m positive if you return to Mexico that none of us will miss you.
:O defrauding the government will result in prison time. Just so you know…
Part of the immigration process includes verifying that the marriage is valid. This means both does the couple live together, etc. *and* is each person legally able to marry? For the US person, they’ll get a residence history and check for marriage licenses in those places. For the foreign person, they’ll do the same thing. The critical part for each is getting an accurate residence history. I can’t help you with this part because I don’t know what the Mexican will say about where he lived in Mexico. If you have information, you can try contacting CIS but you’ll need a minimum of the guy’s name and DOB. Since you’re asking, I’ll guess that you know the US female involved, so you may be able to get some data through her.
The short answer to your question is: Yes.
The longer answer is: But you’ve gotta know who the guy is, where he’s lived and identifying data, like his correct date and place of birth. If he has his Mexican birth certificate, that’ll help a whole lot.
Take care!
